Summary: On 5 September, the Court of Appeal handed down its long awaited decision in UK Serious Fraud Office (SFO) v ENRC [2018] EWCA Civ 2006, bringing back clarity on the applicability of litigation privilege in internal investigations into suspected criminal offences.
