Biography

Tim focuses his practice on commercial disputes and employment litigation (including discrimination and wage-and-hour claims). Tim has tried various cases before judges, juries, and arbitrators in various jurisdictions across the country, and he takes great pride in presenting his clients’ side of the story at trial. Tim also recognizes, however, that trying a case is not always the most suitable method for resolving a business or employment dispute, and for that reason Tim takes equal pride in understanding his clients’ business needs and concerns, and resolving cases short of trial where appropriate. Within his commercial disputes and employment litigation practices, Tim has developed substantial experience in obtaining injunctive relief and defending against such requests for relief (including temporary restraining orders and preliminary injunctions). Tim also has considerable appellate experience, having argued multiple times before the Missouri Court of Appeals and before the U.S. Court of Appeals for the Tenth Circuit.

In addition to his law practice, Tim is committed to serving his community and giving back to his school. Tim serves on the board of “L.E.A.P.” (Lawyers Encouraging Academic Performance), a not-for-profit organization of lawyers and judges engaged in community service to encourage young persons in their pursuit of an education. In addition, Tim serves on the Kansas Law School Board of Governors. Tim is also a graduate of the Kansas City Tomorrow program, which is a year-long, intensive civic-training program run by the Kansas City Civic Council.

Prior to joining the firm, Tim clerked for the Hon. Steve Leben of the Kansas Court of Appeals. While in law school, he served as the editor-in-chief of the Kansas Law Review and as a teaching assistant to the legal research and writing program. Upon graduation, the faculty awarded Tim the Samuel Mellinger Scholarship, Leadership, and Service Award.

  • Defense of request for temporary injunction by various former licensees of national scholarship competition that were seeking to be reinstated; Superior Court of Atlantic County, New Jersey;
  • Issuance of various temporary restraining orders and temporary injunctions and successful defense of various preemptive-strike declaratory-judgment actions in connection with the departure of employees from national investment advisory firm; multiple jurisdictions, including District Court of Johnson County, Kansas, Superior Court of Sacramento County, California, Circuit Court of Davidson County, Tennessee, various Ohio state and federal courts;
  • Defense jury verdict on employment discrimination claims brought under the Missouri Human Rights Act; Circuit Court of Jackson County, Missouri;
  • Dismissal of a lawsuit filed in the Circuit Court of Jackson County, Missouri claiming an eight-figure ownership stake in a large regional bank; affirmed on appeal before the Missouri Court of Appeals, Western District;
  • Summary judgment on claim asserting improper deprivation of several million dollars’ worth of stock, U.S. District Court for the District of Kansas; affirmed on appeal before the U.S. Court of Appeals for the Tenth Circuit;
  • Summary judgment on putative class-action claim under the Missouri Merchandising Practices Act related to allegedly deceptive website; Circuit Court of Jackson County, Missouri.
