Responding to the current financial market conditions, there has been an increasing emphasis in the Finance practice on restructuring and workouts of all forms of debt, structured credit and securitised assets. The focus is on helping you actively plan ahead, to identify effective solutions, to take advantage of opportunities and stay on top of major risks.

In-depth knowledge of key industry sectors means that we understand the commercial environment that you operate in, while our legal expertise across a range of specialisms required ensures that we can deliver clear, accurate advice and creative solutions quickly. Topical issues we have advised on include refinancings, debt for equity swaps, the use of various restructuring techniques, strategic advice relating to the acquisition or disposal of distressed debt, security reviews, dealing with counterparty risks and a wide range of other corporate and financial issues arising from the current market conditions.

Recent instructions on a wide variety of rescues and reconstructions in a variety of sectors include:

  • dealing with complex issues associated with the insolvency of Lehman and the impact this has had on counterparty risk and various securitisations
  • debt restructurings resulting from the huge rump of leveraged debt requiring refinancing
  • advising issuers, trustees, funds and asset servicers in relation to asset disposals and restructurings of distressed and defaulted securitisation transactions
  • advising the restructuring and workout teams of major banks
  • defaults and workouts in the shipping sector and a large number of Forward Freight Agreement defaults.

We are adept at working as part of a multi-disciplinary team and, in particular, work closely with the Restructuring and Insolvency Group when insolvency expertise is required.
