  • Are extended warranties contracts of insurance? - The Court of Appeal has upheld a decision of the High Court that Digital Satellite Warranty Cover Limited and an associated partnership carried on by two individuals should be wound up on the basis that they were carrying on an insurance business.  The application was made by the Financial Services Authority (“FSA”).  As insurance businesses, they required to be authorised by the FSA, and no such authorisation had been given.  The business in question was the provision of repairs to and replacement of satellite television equipment when the original manufacturers’ warranty had expired.  Read more >

  • The Consumer Insurance (Disclosure and Representations) Bill - Draft legislation has now been introduced into Parliament which will provide a statutory and compulsory basis for what has been seen as good practice in the consumer insurance market.  The consequences for the wider insurance and reinsurance market are more speculative.
