Environmental Prosecutions

The Environment Agency, local authorities and other enforcing authorities are bringing an increasing number of environmental prosecutions against companies, their officers (including directors, managers and company secretaries) and individuals in the Magistrates Courts and the Crown Court. 

Environmental prosecutions are brought in pursuance of the Environmental Protection Act 1990, the Control of Pollution Act 1974, the Wildlife and Countryside Act 1981, the Water Resources Act 1991, the Environment Act 1995, the Water Industry Act 1991, the Pollution Prevention and Control Act 1999, the Radioactive Substances Act 1993, the Control of Major Accidents Hazards Regulations 1999, the Packaging Regulations 1997 or other legislation in respect of matters as diverse as waste, contaminated land, water pollution, environmental licensing, packaging, asbestos etc.
