The transfer of wealth between generations and the management of family wealth is increasingly giving rise to disputes even in the most cohesive families.  Litigation costs can have a significant impact on a family’s wealth and we work with families, fiduciaries, trustees, and beneficiaries to put workable governance structures in place to manage the succession to family wealth and family businesses and to avoid disputes and manage risks. 

Where disputes do arise we assist families, trustees, fiduciaries and beneficiaries to agree a long-term solution rather than a short-term fix.  We are advocates of, and regularly use, alternative dispute resolution methods including mediation, expert determination, adjudication and bespoke processes.

We have considerable experience advising on complex multi-jurisdictional trust and succession disputes and have been involved in a number of recent important cases involving challenges to trusts by beneficiaries.
