‘Cartel Offence: Prosecution Guidance’ - CMA’s consultation

On 17 September 2013, the Competition and Markets Authority ("CMA") Transition Team published a consultation paper relating to its prosecution guidance on the criminal cartel offence, discussing the principles to be applied in determining, in any case, whether proceedings should be instituted under the criminal cartel offence. In addition, on the same date, the Department for Business, Industry and Skills published draft secondary legislation regarding the ability to publish relevant information about agreements between businesses to bring them outside the criminal cartel offence.
