We reported on the draft TUPE amendment Regulations in September 2013. Final form Regulations, The Collective Redundancies and Transfer of Undertakings (Protection of Employment) (Amendment) Regulations 2014, have now been laid before Parliament.
The changes introduced by the final Regulations are broadly as anticipated in the draft Regulations. These changes are discussed in more detail in our updated BLP: Looking Ahead TUPE Factsheet.
Most of the changes come into force on 31 January 2014. However, the extension of the time period for providing employee liability information to 28 days takes effect from 1 May 2014 and the ability for micro-businesses to consult directly with employees in certain circumstances takes effect from 31 July 2014.
