Summary: On 5 September 2013, the Government published its response to the consultation on proposed changes to TUPE. The response is as notable for what is not being changed, as what is. Most significantly the service provision change test is being kept (but revised), along with the obligation on transferors to provide employee liability information.In the latest of our BLP: Looking Ahead series, we set out a summary of the proposed changes to TUPE. The Government plans to lay the draft legislation before Parliament in December 2013 and it is anticipated that the changes will come into effect in January 2014.

On 5 September 2013, the Government published its response to the consultation on proposed changes to TUPE.  The response is as notable for what is not being changed, as what is.  Most significantly, the service provision change regulations are being kept (with revisions), along with the obligation on transferors to provide employee liability information.
